Important Notice / 重要提示

Flux Art respects intellectual property rights. This policy explains how to submit a takedown notice, how to file a counter-notice, and our policy on repeat infringers. All notices must be sent to [email protected].

This Copyright & Intellectual Property Complaints Policy ("Policy") is issued by MORNING STAR INDUSTRY LIMITED, a company incorporated in Hong Kong, operator of the Flux Art platform at https://flux-art.ai (the "Services"). This Policy supplements and forms part of our Terms of Use and operates alongside our Acceptable Use rules.

We provide this notice-and-takedown procedure on a global, good-faith basis, modeled on Section 512 of the U.S. Digital Millennium Copyright Act ("DMCA") and incorporating the equivalent obligations of the EU Digital Services Act, the U.K. Online Safety Act, and other applicable platform-content laws. You may use this process regardless of where you are located and regardless of where the rights you assert arise.

Scope of Rights Covered

You may use this process to report content available through the Services that you in good faith believe infringes:

  • your copyright in a literary, artistic, photographic, cinematographic, musical, audiovisual, or software work;
  • your registered or unregistered trademark, service mark, or trade dress;
  • your right of publicity, image right, name right, or other personality right (including unauthorized use of your name, likeness, or voice);
  • your right against the unauthorized public disclosure of intimate imagery; or
  • any other intellectual or personality right recognized under applicable law.

For complaints about other categories of prohibited content (e.g., CSAM, harassment, fraud, non-consensual intimate imagery), please email [email protected] with the subject line "Trust & Safety Report" and we will route the report to the appropriate team.

How to Submit a Notice of Infringement

Send an email to [email protected] with the subject line "Copyright Notice — [Your Name / Company]". To be actionable, your notice must include all of the following:

  1. Identification of the work or right claimed to be infringed — for copyrighted works, describe the work and, where available, provide a registration number, public URL, or representative sample; for trademarks, provide the mark and, where applicable, the registration number and jurisdiction; for publicity-right or image-right claims, identify the person whose rights are asserted and your relationship to that person;
  2. Identification and location of the allegedly infringing material on the Services — provide the full URL(s), the user account or handle, the asset ID (where visible), and any other information reasonably sufficient for us to locate the material;
  3. Your contact information — full legal name, postal address, telephone number, and email address; if you are acting on behalf of a rights holder, also provide the name of the rights holder and your role / authorization;
  4. A good-faith statement in substantially the following form: "I have a good-faith belief that the use of the material described above in the manner complained of is not authorized by the copyright/trademark/right holder, its agent, or the law.";
  5. A statement of accuracy under penalty of perjury in substantially the following form: "I swear, under penalty of perjury (or an equivalent declaration of truthfulness under applicable law), that the information in this notice is accurate and that I am the rights holder or am authorized to act on behalf of the rights holder."; and
  6. Your physical or electronic signature.

Where a notice is materially incomplete, we may ask you for additional information before we are able to act on it. Notices submitted via channels other than the designated email address may experience delays.

Our Response and Timeline

We aim to acknowledge properly submitted notices within five (5) business days of receipt and to complete our initial review within fourteen (14) business days. Where the notice is clearly meritorious — for example, exact reproduction of a registered copyrighted work — we will typically act sooner.

If we determine, in our reasonable judgment, that the reported content likely infringes the rights asserted, we may take one or more of the following actions:

  • remove or disable access to the reported content;
  • notify the user who uploaded or generated the content;
  • retain a log of the removal and the underlying notice;
  • where applicable, restrict the user's ability to re-upload or re-generate the same or substantially similar material; and
  • in cases of repeated or egregious infringement, suspend or terminate the user's account under Section 6 below.

If we determine that the notice is insufficient, mistaken, or directed at content covered by fair use / fair dealing or other lawful basis, we may decline to act and will notify you of the basis for our decision where reasonably practicable.

Counter-Notice Procedure

If your content has been removed or disabled in response to a notice and you believe the removal was the result of a mistake or misidentification — for example, you hold a license, the use is fair use / fair dealing, or the work is in the public domain — you may submit a counter-notice to [email protected] with the subject line "Counter-Notice — [Account / Asset ID]" and the following information:

  1. identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled;
  2. your full legal name, postal address, telephone number, and email address;
  3. a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. a statement consenting to the jurisdiction of the courts of Hong Kong (or, where required by applicable law, the courts of the federal district in which you reside or, if you reside outside the United States, the courts of any judicial district in which Flux Art may be found), and that you will accept service of process from the person who provided the original notice or that person's agent; and
  5. your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original notifier. Unless we receive notice within ten (10) business days that the notifier has filed an action seeking a court order against the user, we may, in our discretion, restore the removed material. Restoration is not guaranteed and may be withheld where the content otherwise violates these Terms or applicable law.

Misrepresentation and Abuse of Process

Under 17 U.S.C. § 512(f) and the equivalent provisions of other applicable laws, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, the copyright owner's authorized licensee, or Flux Art.

We reserve the right to reject, deprioritize, or refuse to process notices and counter-notices that we reasonably believe are being submitted in bad faith or as part of a pattern of abuse, and to share evidence of such abuse with affected parties and competent authorities.

Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A user will generally be considered a repeat infringer if they have received two (2) or more valid takedown notices that have not been successfully counter-noticed within any 12-month period, or if a single course of infringing conduct is sufficiently egregious that immediate termination is warranted.

Where an account is terminated under this Policy, we may:

  • forfeit any unused credits, entitlements, or unredeemed promotional benefits without refund;
  • retain logs, generated outputs, and account records as evidence;
  • block re-registration under the same or related identifiers; and
  • cooperate with rights holders and authorities investigating the matter.

Note on AI-Generated Outputs

Flux Art is an AI platform that generates images and videos in response to user prompts and reference materials. Where a user's prompts, reference uploads, or instructions cause the Services to produce output that infringes a third party's rights, primary responsibility rests with the user who directed the generation. Notwithstanding that, we will act on properly submitted notices regarding specific outputs hosted on or distributed through our Services in accordance with this Policy.

If you believe that an entire prompt category, model, or feature on the Services is being used systematically to infringe your rights (for example, a model fine-tuned to reproduce a specific copyrighted franchise), please describe the pattern in your notice. We will evaluate whether prompt-level, model-level, or feature-level mitigations are appropriate in addition to per-asset takedown.

Changes to this Policy

We may update this Policy from time to time to reflect changes in the Services or in applicable law. Material changes will be communicated through the Services or by email. The date of the latest revision is indicated at the top of this page.

本《版权与知识产权投诉政策》(以下简称"本政策")由在香港注册成立的 MORNING STAR INDUSTRY LIMITED(即 Flux Art 平台 https://flux-art.ai 的运营方,以下简称"本服务")发布。本政策是《服务条款》的补充,并与《可接受使用规则》同时适用。

我们在全球范围内以诚信原则提供本"通知—删除"程序,参照美国《数字千年版权法》(DMCA)第 512 条设计,并兼顾欧盟《数字服务法》、英国《在线安全法》及其他适用平台内容法律的同等义务。无论您身处何地,也无论所主张权利的来源地,您均可使用本程序。

本政策涵盖的权利范围

您可使用本程序就本服务中可获取的内容提出投诉,前提是您善意相信该内容侵犯了以下权利之一:

  • 您对文字、美术、摄影、影视、音乐、视听或软件作品的著作权;
  • 您已注册或未注册的商标、服务标记或商业外观;
  • 您的形象权、肖像权、姓名权或其他人格权(包括未经授权使用您的姓名、形象或声音);
  • 您反对未经同意公开传播私密影像的权利;或
  • 适用法律所承认的其他知识产权或人格权利。

对其他类别的违规内容投诉(如 CSAM、骚扰、欺诈、未经同意的私密影像等),请通过 [email protected] 发送邮件,主题注明 "Trust & Safety Report",我们将转交相应团队处理。

如何提交侵权通知

请向 [email protected] 发送邮件,主题为 "Copyright Notice — [您的姓名 / 公司名称]"。为使我们能够处理,您的通知须包含以下全部信息:

  1. 被主张受侵害的作品或权利的说明——对著作权作品,请描述作品本身,并尽量提供登记号、公开 URL 或代表性样本;对商标,请提供商标及登记号、地域范围(如适用);对形象权 / 肖像权主张,请指明被主张权利之人,并说明您与该人的关系;
  2. 本服务中被指控侵权材料的位置与定位信息——请提供完整 URL、用户账号或用户名、资产 ID(如可见),以及任何其他能合理帮助我们定位该材料的信息;
  3. 您的联系方式——完整真实姓名、通讯地址、电话与邮箱;若您系代权利人行事,请同时提供权利人姓名及您的身份 / 授权依据;
  4. 善意声明,建议措辞如下:"我善意相信上述材料按所投诉的方式被使用,未获著作权人 / 商标权人 / 权利人、其代理人或法律的授权。";
  5. 在伪证罪责(或同等真实性声明)下作出的准确性声明,建议措辞如下:"我在伪证罪责(或适用法律下的同等真实性声明)下声明:本通知所载信息真实准确,本人系权利人或经授权代权利人行事。";以及
  6. 您的实体签名或电子签名。

如通知存在重大缺陷,我们可能要求您补充信息后方能处理。通过非指定邮箱提交的通知可能会延迟处理。

我们的响应与时限

对依规提交的通知,我们将力争在收到后 5 个工作日内予以确认接收,并在 14 个工作日内完成初步审核。对事实清晰的明显侵权情形(例如对已登记著作权作品的完全复制),处理时间通常更短。

经合理审核,如我们判断被举报内容可能侵犯所主张权利,我们可能采取以下一项或多项措施:

  • 删除或禁用对相关内容的访问;
  • 通知上传或生成该内容的用户;
  • 留存删除日志及对应通知;
  • 在适当情形下,限制该用户重新上传或重新生成相同 / 实质相似材料的能力;以及
  • 对重复或严重侵权,根据下文第 6 条暂停或终止用户账户。

如我们判断通知不充分、有误,或所投诉内容属于合理使用 / 公平交易或其他合法依据下的使用,我们可拒绝采取行动,并在合理可行的范围内向您说明依据。

反通知(异议)程序

如您的内容因侵权通知被删除或禁用,而您认为该处置系出于错误或误认(例如您持有许可、构成合理使用 / 公平交易,或作品已进入公有领域),您可向 [email protected] 提交反通知,主题为 "Counter-Notice — [账号 / 资产 ID]",并应包含以下信息:

  1. 被删除或禁用的材料及其在被删除前出现的位置;
  2. 您的完整真实姓名、通讯地址、电话与邮箱;
  3. 在伪证罪责下作出的、您善意相信该材料被错误或误认地删除或禁用的声明;
  4. 同意接受香港法院管辖(或在适用法律强制要求时,您居住地所在联邦司法辖区法院;如您居住于美国境外,则任何 Flux Art 可被找到的司法管辖区法院)的声明,以及您将接受原通知方或其代理人送达诉讼文书的声明;以及
  5. 您的实体签名或电子签名。

收到有效反通知后,我们会将其转发原通知方。如在 10 个工作日内未收到原通知方已对该用户提起法院诉讼的通知,我们可酌情恢复被删除的材料。恢复并非必然,且对仍违反本条款或适用法律的内容,我们可拒绝恢复。

虚假陈述与滥用程序

根据 17 U.S.C. § 512(f) 及其他适用法律的同等规定,明知地、就材料是否侵权或是否系误删 / 误认作出实质虚假陈述者,可能须对被指控侵权人、权利人、其授权被许可人或 Flux Art 因此而产生的损失(包括费用与律师费)承担赔偿责任。

对我们合理认为出于恶意或属于滥用模式提交的通知与反通知,我们保留拒绝、降级处理或不予受理的权利,并可就该等滥用证据与受影响方及主管机构共享。

重复侵权者处置政策

我们的政策是:在适当情形下终止重复侵权者的账户。一般情况下,如用户在任何 12 个月期间内收到两份(2)及以上有效的删除通知且未成功提交反通知,或单次侵权行为情节严重而足以立即终止账户的,将被认定为重复侵权者。

账户被依本政策终止的,我们可能:

  • 没收任何未使用的积分、权益或未兑换的促销利益,且不予退款;
  • 留存日志、生成输出及账户记录作为证据;
  • 在同一或关联标识下阻止重新注册;以及
  • 配合权利人与主管机构就相关事项的调查。

关于 AI 生成内容的说明

Flux Art 是基于用户提示词与参考素材生成图像 / 视频的 AI 平台。如用户的提示词、参考上传或指令导致本服务产出侵犯第三方权利的输出,主要责任在于指挥该次生成的用户。即便如此,对于在本服务上托管或经由本服务传播的具体输出,我们仍将依本政策对依规提交的通知采取行动。

如您认为本服务中的某一整类提示词、某一具体模型或某一项功能正被系统性地用于侵犯您的权利(例如某个针对特定受版权 IP 的微调模型),请在通知中描述该模式。除按资产逐项删除外,我们将评估是否在提示词、模型或功能层面采取额外的缓解措施。

本政策的变更

我们可能因本服务或适用法律的变化而不时更新本政策。如有重大变更,将通过本服务或邮件方式通知您。本页顶部标注的修订日期为最新版本日期。
